I think we first need to know the draft's draft status ::worry::
Daly said last week that there will definitely not be a draft unless a CBA is done. That being said, I believe the NHL's new goal is to have a CBA done by June so they can do a draft and start a major publicity campaign for 05-06. Not sure how they'd figure out a draft order.
Use last year's finish or random drawing by the teams.
Using last year's finish would be totally unfair especially considering this year's crop is particularly strong. Random drawing far more likely.
And just as this conversation is happening, I get an email about this exact topic. From Fox Sports:
"No matter the result of that legal wrangling, a draft must be held before the next NHL season begins. The NHL's Bill Daly has said the order of the draft would be decided in a 30-team lottery weighted on the results of the 2003-04 season."

Seems like round-by-round random drawing, done in advance, would be a reasonably fair way to have a draft "from scratch".
