"Before they put me in handcuffs I asked to take a breathalyzer," said Rust. Instead, he says, police put him in handcuffs and took him to the St Joseph County Jail.

"At jail, I received a breathalyzer and blew triple zeroes, so I hadn't been drinking, but they still proceeded to put me in jail, where I stayed from 1 til 9:30 the next morning," he said.
I don't know which is worse, drinkers or the cops.

In Indiana they have what is called "The Excise Police (http://www.in.gov/atc/isep/)". I never had any encounters with them but the undergrads at Purdue had some interesting tales about them.

This includes the Excise Police going on private property where a social gathering was occurring (gathering I think was more than 3 people) and asking to see ids and arresting everyone if there was any hint of alcohol and any one underage.

Also, they have been known to arrest people for being drunk while on the free campus "get home safely" shuttle. Really. I found this disturbing, considering the people on the shuttle had enough sense to get a ride back to the dorms rather than wander aimlessly in the streets or drive a car.

In this case Jim, I would say the Excise Police, guilt by association with them.

Is a measurable BAC illegal if you're under 21 and if you're not in a motor vehicle?

It is in many states: "Minor In Consumption"

I was thinking of a minor in Bourbon. After all that is where the barrels that age Scotch come from. Thrifty those Scots.

On the other hand defending ones thesis in oral argument might be an enjoyable event as the questions evolved unless we entered the neat vs ice and a splash religious wars.

To establish you've been drinking, I guess.  If MTV "Busted" is to be believed, in Maryland at least you can be cited for "public nuisance" if you test as intoxicated while walking, whether you're 16 or 36.  Which sounds stupid, until you've tried to drive past people reeling down Eddy Street at 3 a.m.
