What you believe about Age's picture doesn't matter very much. Trademark holders need to enforce their mark on every apparently unauthorized use of it, or they lose their mark. If Age mounts a reasonable defense under "fair use," they can back down, or they can take him to court and risk losing. First of all, one of the reasons institutions employ people to send out letters like that is because the courts have long interpreted a lack of effort to enforce intellectual property ownership as a sign that you're not interested in retaining it. In fact in lawsuits over trademark infringement, the owner can't just show that someone else used their mark - the owner usually has to provide evidenby Beeeej - Hockey

Well, I have to admit that I'm tempted to draft the letter to Cornell Magazine myself. I've been known to string a few good words together from time to time. (Sadly, the most easily available example is ...) Goodness knows that Inge would be surprised to see my name at the bottom after I worked for her for five years. I happen to like Andy as a human being, too. Of course he and others in Athletics make decisions differently from the ones we would make - and we can judge them for it, but we can't say we know all of the factors that went into their decisions or all of the competing pressures they were under when they made them. I was sort of lamenting the fact that we won't get to play Providence this fall; in the last fifteen years, it's been an unusually frequent occurrence that the one team in the NCAA who has a theoretical shot at a perfect season has to come through us to do it, and we're the ones to take it away from them. Unless something in Cornell's policies or the federal tax code has changed drastically, membership dues in the CHA are not deductible from your income for purposes of calculating your taxes. Members receive far too much benefit from their dues for them to be tax-deductible; there is a quid pro quo here that goes way beyond the standard 2% "de minimus." I tend to presume that the same is true for most others, too - and I say this with the goal of reducing the general frequency of "You have mail" postings cluttering up eLF. I think John's point is that these are supposedly reasonable, intelligent people who are making the rules, and after several years in a row of screwing things up, they really should have a pretty good idea by now of where the problems are going to be. Heh... I knew that, too. I think it's just something about the ridiculous workload in the first year of law school that makes you be less careful about everything except classwork. If you read a bit further into that paragraph, you'll see that they actually do address the question of "I only want to listen to one game." There's a 14-day free trial available.
